Possession of Assault Firearm

Changes the penalty for the unlawful possession of an assault firearm from a third degree crime to a second degree crime.
Second degree crime carries a stiffer penalty.
- Punishable by term of imprisonment of not less than 5 years and as high as 10 years.
- Fine of $150,000
- Violator can receive both prison time and a fine
Current law: Unlawful possession of assault firearm is third degree crime punishable by imprisonment of 3-5 years and up to $15,000 fine.
Raising the penalty increases the likelihood of even a first time violator going to prison.
Unlawful Transfer of Firearm
S-753……Senator Turner
Upgrades penalty for unlawfully transferring a firearm to an underage person.
- Any person who unlawfully sells, gives, transfers or disposes of a firearm to a person under the age of 18 would be guilty of a second degree crime with a mandatory minimum prison time of 5 years without parole.
- A crime of the second degree is punishable by a fine of up to $150,000 and 5 to 10 years in prison; or both.
Under current law, this is a third degree crime punishable by fine up to $15,000 and mandatory 3 years prison time.
