Governor Issues Conditional Veto of Flooding Notification Bill

As part of his conditional veto of S-3110/A-4783, Governor Murphy has suggested the bill be amended to provide that a tenant whose landlord fails to provide the required notifications may terminate the lease without penalty any time after the tenant becomes aware that the property is located in a flood plain. As passed by the legislature, a tenant could only terminate the lease without penalty if the landlord failed to provide notice and the tenant suffered damage to their personal property equal to five times the amount of their monthly rent.

The bill is now returned to the legislature for consideration of the Governor’s amendments.
