DCA Issues Proposed Rules Regulating Third-Party Inspectors

The Department of Community Affairs (DCA) has published proposed rules amending the Uniform Construction Code (UCC) to expand the use of private on-site inspection agencies, in accordance with the law adopted last year. 

In accordance with P.L. 2022, c. 139, the DCA has proposed for adoption rule amendments related to private on-site inspection agencies, or third-party inspectors. 

Specifically, the proposed rulemaking provides for expanded use by municipal enforcing agencies of shared services or private on-site inspection agencies and allows for contractors to utilize private on-site inspection agencies when a municipality fails to meet the required timeframe to perform an inspection.

The League is reviewing the proposed rules and anticipates submitting comments. Written comments on the rule proposal are due by October 6. If you plan to submit comments, we kindly ask that you share a copy with the League’s Associate General Counsel, Frank Marshall, at fmarshall@njlm.org.
